Terms of Service

4.1 Permitted Use

You may use the Service to generate professional headshots for personal or commercial use, including but not limited to LinkedIn profiles, resumes, company websites, marketing materials, and business cards.

4.2 Prohibited Use

You agree not to:

• Upload images that you do not have the right to use or that violate third-party rights
• Upload images containing nudity, violence, hate speech, or illegal content
• Upload images of minors without proper parental consent
• Submit photos for passports, visas, driver's licenses, government identification, platform KYC, or any other official identity verification workflow
• Impersonate or attempt to impersonate another individual, whether living or deceased, or misrepresent your affiliation with any person or organization
• Use the Service to create deepfakes or misleading content intended to deceive
• Attempt to reverse engineer, decompile, or extract the AI models used by the Service
• Use automated systems (bots, scrapers) to access the Service without authorization
• Resell or redistribute the Service without our written permission
• Use the Service for any illegal, harmful, or fraudulent purpose

5.1 Your Content

You retain all ownership rights to the images you upload. By uploading an image, you grant us a limited, temporary license to process your image using our AI technology solely for the purpose of generating your headshots, delivering the finished files to you, and providing customer support upon request. We do not use user-uploaded images or generated headshots to train our models or develop new AI systems.

5.2 Generated Content

Upon payment, you receive full commercial and personal usage rights to the AI-generated headshots. You may use these images for any lawful purpose without attribution. We do not claim ownership of the generated images you have purchased.

5.3 Our Intellectual Property

The Service, including its AI models, algorithms, design, code, and branding, is owned by InstantHeadshot.ai and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Service without written permission.

6.1 Pricing

The current price for 8 high-resolution AI headshots is $19 USD (one-time payment). Prices are subject to change at any time, but changes will not affect purchases already completed. You can preview generated results before making a payment decision.

6.2 Payment Processing

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service and privacy notice. We do not store your credit card information; all card data is transmitted directly to Stripe over SSL/TLS. If we add additional processors in the future, we will update this policy accordingly.

6.3 Taxes

You are responsible for any applicable taxes, duties, or government charges related to your purchase based on your jurisdiction.

8.1 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be unavailable due to maintenance, upgrades, technical issues, or circumstances beyond our control.

8.2 Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT GENERATED IMAGES WILL MEET YOUR SPECIFIC EXPECTATIONS.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTANTHEADSHOT.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS.

9.3 AI Limitations

AI-generated images may not be perfect and can occasionally produce unexpected results. While we use advanced AI technology, we cannot guarantee that every generated image will meet professional photography standards or your specific requirements. This is why we provide previews before purchase.

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved first through good faith negotiation. If negotiation fails, disputes shall be submitted to the Hong Kong International Arbitration Centre (HKIAC) for final and binding arbitration in accordance with the HKIAC Administered Arbitration Rules then in effect, except where prohibited by law.

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and InstantHeadshot.ai regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
